We have an drainage/storm water easement (I know there is a man hole just before our block starts) on our property - which the council have told us is the responsibility of us and our neighbour, as it is not on their plans. I have looked on the plans and it clearly shows an easement between mine and our neighbors house. I am assuming that both my neighbour and I own half, half. My issue is that every year when we get bad rain it washes out really badly. For the past four years we have maintained it. I am just wondering what the law is regarding the maintenance of such easements?
