Hi there,

Could anyone help me, please? I am an international student from India and I was married in India for one year before coming to Australia. I need to know can I file my divorce in Australia? What's the procedure of the same and how much time it will take?

You need to meet certain conditions in terms of citizenship.

You or your spouse must:
  • Regard Australia as your home and intend to live in Australia indefinitely, or
  • Be an Australian citizen by birth, descent or by grant of Australian citizenship, or
  • Ordinarily live in Australia and have done so for 12 months immediately before filing for divorce.
You also must have been separated for at least 12 months before applying for divorce in Australia.
