VIC Cross Intervention Order on Ex for Emotional Abuse and Stalking?

    I was the stay-at-home and have been served with an Intervention Order and it covered my ex and the children, which is vindictive and completely false. I have multiple pieces of evidence to disprove her claims. Unfortunately, my children have been isolated and alienated from me and are getting bought and manipulated.

    In the recent events after Intervention Order, I was tracked on my iPhone (trying to breach my orders). My ex submitted evidence to police in which I was not charged and I have asked them to further investigate as it is illegal and a criminal offence (besides the prints out's clearly altered). She was also caught, witnessed and photographed stalking me inside a specific location and has financially cut me off.

    The courts said that the children could contact me if they want. "Sure" their phones were changed and my family and I were disconnected from social media from them and my phone was also disconnected and the list goes on and on.

    I want to a Cross Intervention Order on her based on the stalking, tracking and emotional abuse (financial, parental alienation). Will it hold up?

    Cross applications are sticky. If there's a contravention, the police have difficulty proving who breached what because there's two orders in place.

    Where are you at with proceedings for the existing IVO?

    Have you started any processes for spending time and communicating with your kids?

    Yes, I have started the process by going through Family dispute resolution service, but I doubt if she will agree to it.

    We are booked in for a second directions hearing at the end of next month
    I have also booked in for an application for an IVO cross app on same day so they can be heard together ?

    I have started a process through Family dispute resolution , but i doubt if she will communicate back where the difficulty is that i have been total finacially cut off and i was dependant on her . So i am currently living in Sydney with my parents and due to technically having money but no access , i am unable to get any sort of government assistance
