Hi,

Apologies for my lack of understanding, however, I am still a bit confused as to whether you can commence Criminal Law Action at the same time or after Civil Law Action.

I have recently been advised that I cannot commence Criminal Law Action until Civil Law Action has completed. This seems surprising in that Civil Law Action can take up to 2 years or more leaving the accused to commit more crimes?

Can someone please clarify for me?

If someone does an "act" that they are guilty of in both Criminal Law and Civil Law, do they need to be found negligent in Civil Law prior to being charged under Criminal Law?

Or can they be charged under Criminal Law first and then be sued under Civil Law? Or can both Criminal Law and Civil Law proceed at the same time?
