I cannot find a law in WA that pertains to retaining walls. We have the Dividing Fence Act 1961 which does not mention retaining walls. Retaining walls are under the jurisdiction of local governments, however, my shire is unable to give a clear answer in regards to their current policy. My question is if the current policy states' that changes to ground levels through the excavation or filling of land, do not adversely affect neighbouring properties' , does this make the current owners of the land which was excavated nearly 60 years ago liable for the replacement of the very old and crumbling retaining walls between our properties?
