I have a legal question. If a neighbour built a retaining wall close to the boundary (on their side) or on the boundary prior to our property being developed (a good 8 years) would they own the wall? We’re on the high side and the wall is neglected and poorly built and we have concerns about future damage to our property.

You haven't said in what State you live. In many States the owner who changed the ground level is responsible for the wall.
