If legal advice was sought by the Commonwealth Department of Tourism from an external law firm, and the Department of Tourism passed that legal advice onto National Cabinet, has Legal Professional Privilege been breached?
From what I understand, if legal advice is passed onto a third party or made public, then that is a breach of legal professional privilege.
OR...
Is legal professional privilege only breached where a member of National Cabinet openly stated the conclusions of said legal advice to the public?
