is it an offence for a driver hold a mobile phone in hand at a red light - although not using it not for talk or text - just fiddling with it as if holding a banana -
got a fine quoting code 2497 and RR 304 J (1)

Yes. Being stopped at a red light is still "driving".

1. I cant find the infringement code nor the Road rule they quoted - can you please provide it or let me know if they had made a mistake.
is one not allowed to hold anything in hand whilst driving?
what if police mistakenly wrote mixed up family name with given names is it considered a deficient notice and is void?

Check the code and road rule again. Are you from Victoria, or mistakenly enter the incorrect State?

In Vic, RR 300 is about using mobiles phones - and yes your description is an offence.

RR 304(J) doesn't exist.
