Thank you CathL, I appreciate your reply and agree that he does have rights to the property and will get his fair share when it is sold. However, considering that he has denied me right of access to the property and denied my right to make an income from the property, when that was the purpose it was bought for and was part of our loan agreement, and that I have sold my own private properties and received an early release from my own Super to maintain the mortgage repayment on the property and he has allowed the property to deteriorate significantly, I feel I need to make a move on it. Also I can not see the point of settling when the bank would not refinance us separately and the property is in such disrepair that it is not tenantable or sellable without making a significant loss. I do appreciate your suggestions though and will seek the advice you suggest. Thank you.
