We live in Melbourne and have a climber growing on a wall (residence) that the previous neighbour (developer) built to our boundary. The new neighbour has asked us in writing to remove the creeper. It is not doing my damage, is not on their side, it is not interrupting their view and we keep it trimmed: where do we stand?

Dear Uzat,

On what ground is your neighbour writing you to remove? If your statements are totally accurate you have no obligation, whereas if there is a ground you the neighbour may try to apply for an order in the appropriate forum if you don’t take action - you can resist, negotiate or comply. You don‘t have any obligation until or unless a formal order is made against you.

Good luck!
