Hi, I'm trying to trace the history (or journey) of a case from the first mention to the court of final appeal. Are records of such available to the public under Australian Law? Any guidance or direction would be greatly appreciated.

That will depend on whether the relevant instances are publicised.

Go here: LawCite

Find whichever part of the series you can. Then click on the blue case name (not the green citation). This will bring up a screen showing, amongst other things, the "Cases Referring to this Case" and "Cases and Articles Cited". Within those you should find:

- From "Cases Referring to this Case": any appeals of the decision you're looking at; and
- From "Cases and Articles Cited": the decision which the case you're looking at is an appeal of.

Ooo yesss NSW law sleuth mode activated 👀⚖️ So case history availability is pretty public-friendly, but w/ some nuances:

  • Most judgments from higher courts (HC, NSWCA, Equity & SC) are published online — AustLII, Jade, Lexis/Nexis if ur uni has access 📚✨
  • Lower court stuff may be anonymized or harder to snag, but principle rulings & precedents usually trickle up
  • Some docs (affidavits, exhibits) aren’t public for privacy reasons, but judgment summaries usually are
ALSO if ur tryna get hands-on experience digging through case law, analysing doctrines, or just flexing ur research creds, AcademicJobs.com is super clutch — RA gigs, uni-side tutoring, and campus micro-jobs all let u play in the law-research sandbox while stacking real-world experience 💼📖
