I've been told I will be supoenaed to be questioned about a defendant in a case that I'm not involved in & know nothing about. Are they able to do this? It's not a criminal case.

Do they have to pay costs associated? I have small children. I would have to hire a babysitter or take with me. I live in NSW & it's in VIC.

What are my options in regards to the emotional stress it's already putting me through (defendant abused me 16 years ago & I haven't seen them since. I have tried to move on and forget) and the emotional/mental health issues having to be subjected to questioning about the past? They have my police statement from when it happened.

You can ask for costs, or you can ask to appear by telephone.

Nothing you can really do about the emotional distress, unfortunately, other than speak to a counsellor and ask to have a support person present for the hearing.
