I am a part time employee with no contract and been employed with this employer for 2 years.
Employer recently trim my hours from 35 to 25 hours and advise that they could further axe more hours. The employer have posted notice in the staff room notifying all staffs that there could be a cut of working hours due to a need for work place changes.
The award and NES required the employer to consult with effected employee prior to any changes.
I was given a notification of changes in the roster with my regular hours cutted.
My question is:
1. what consitute consultant?
2. Must the effected employee given notice in writing prior to hours cut?
3. The fact that I do not have an employment contract would that give the employer the advantage to cut without consult?
4. Without a contract, can I still argue that my hours for the last two year's consitute my regular hours of work?
5. Can I argue that the employer paid me weekly for work I performed do represent a contract do exist?
