If a venue states that you pay 55% if they can't resell the date and make no efforts to advertise, is that fair according to Australian Consumer Law?

  2. Was it for a personal or business event?

Further to the above questions, look over your contract (assuming you have one) to see if there's any 'reasonable efforts' clause upon which the cancellation fee is conditional.

If there is, that's obviously helpful. However, it also depends on what you mean by 'no efforts to advertise', for example do you mean over and above their general marketing efforts?
