On my husband's first drink driving offence, he blew 0.153. He had Gastric Bypass Surgery 11 months ago. Would it be worth mentioning this to the Judge to be granted a lesser sentence or a work licence?

It could help not sure how it will, drink driving is considered a very serious offence and the court do not go lightly. If this is your husband's first fine and he has a good driving record (no traffic fines for 10yrs or more) and explain it was normal behavior, one off, the magistrate may give you a lesser infringement. It will depend on what is written, your husband's history.

Tell the magistrate but for his information it is recommended to consume no alcohol at all prior to driving.
