Under contract law, can an engineering design company charge (10K) for reviewing a design, and advising that there is nothing that they can do for the issues affecting the design?
Can they then use this claim to withhold current works which was a quoted scope?

A quote was given to redesign the structural component of a development that had been engineered (by others) outside of the approved building envelope, once the drawings were forwarded this company did a review and then advised that they could not come up with a solution to the problem, then presented an invoice.
They were concurrently completing the civil design work for this same development, work which is not disputed but not progressing until the redesign is completed (by others)
