I am currently in my HSC year and I told my manager/boss over 6 months ago that on two sperate occasions, I will not be able to come to work for study reasons as I have an exam early the next morning (I work late on Thursday nights, only for three hours and my exams are both on the Friday morning). She has denied me to take those two shifts off because "she does not have anyone else to work in place of me then".

As she has know for quite some time and there are 35 other employees that could easily replace me on those particular shifts, is that fair under employment law?

Is it fair? No, doesn't sound fair.

Is it legal? No, I assume that you have annual leave left?

If your manager persists I would make a call to Fair Work Australia.
