My property in Victoria fronts a named road, but also backs onto an un named road, that only has one outlet. Across the un named road is a subdivided block, one of the two lots being a battle axe. The battle axe’s drive way is split lengthwise on the title with one side being called ‘ easement of carriageway and water supply’ and it’s labelled E1. My direct neighbour who is directly behind the subdivided block, has on their title ‘ the right to use and maintain the easement of carriageway’, they also need to cross the un named road to access this carriageway.
My question is can I use the un named road to access E1 then go along E1 as this is access to another named road and ultimately the beach?
