Hi,

I’m in the process of investigating an idea for a new app.

After some searching, there are two key hurdles I’m hoping to get some guidance on (in QLD but more broadly Australia)

Firstly a privacy concern:

1. Is it illegal to post an individual’s mobile number as their primary reference for an online review (i.e. no names, addresses)?

2. If it is illegal, would anything ever permit this to occur (ie. safety concerns)?

3. Lastly, if the user could search a number but it was partly masked (see below) would that not be considered a breach?

Second is defamation (which I understand is much stricter in Australia).

3. If a negative review is submitted, and defamation suit occurs, as the platform that published we would still be liable if proved guilty?

4. Can the sign-up policy of an app/web site mitigate part or all of these responsibilities by confirming what has been written is truthful or their honest opinion?
