Our property has a 3 metre high boulder wall (approximately 40 meters long) that was constructed by the land developer approx 6 years ago. The base of the wall is actually just inside the neighbour's property line therefore the entire wall sits within their boundary. One of the rocks that lies about halfway up the wall is of a different type and has been cracking more over time. Our concern is that if it fails completely, then several of the boulders above it will likely collapse and roll onto our property with resultant damage.
There is still one stage of the development to be completed so the developer is still in the area.
Who is responsible for the repair work - the land developer, the engineer who certified the wall, the local council who signed off on the development, our neighbour (as the wall is entirely on their land), or does it fall to both us and our neighbour to share any costs?
