looking for some info here.
My father was pulled over randomly in October 2020 and was told his license was suspended due to medical review.
Apparently Vic roads sent a letter to him in feb 2019. he never received it and it basically said he needed to get a medical clearance to drive otherwise his license would be suspended. (i rang up a few days ago and got a copy of the letter)
As my father did not receive this letter... or a reminder.. or a cancellation of license letter.... or asked to hand in his drivers license.. he kept on driving.
he has now been issued with a magistrates date to go to court...
my question is:
Changes to Road Safety Act 1986 Deemed Service of notices VicRoads notices are deemed ‘served’ seven days after they were sent, even if the notices are returned undelivered.
this change was made in october 2019.
My fathers letter that they are saying was sent in Feb 2019... so can i fight it that it was not received.
