Good morning,
My sister is a joint executor of a will. The other executor is the husband who is also a beneficiary. The estate (super) is going equally to her young daughters (in trust) with a percentage going to the husband.
My sister recently received correspondence from the solicitor and an account of the activity to date. It states that the husband has been paid out his share and all the funeral/legal costs etc have been taken out of the daughters share (which is not what the deceased wanted). My sister had to seek approval from the other executor (husband) to transfer vehicle registration over, though she was not asked to approve the payment transfer to the husband (executor). Is there any action she can take against the solicitor? Can she request the funds to be returned to the estate?
