Hello,

I had previously lost my drivers licence for 24 months. Now this happened in October and I didn't have a hearing until the following year in March. I was obviously given two years from that court date in March.

I never asked about the months done before as I had lost it in October. Is it possible to get this reduced or seen as time done to the penalty?

There is 5 months in limbo there.

Regards

I'm sorry but I'm a bit confused with regard to your situation. In Victoria your licence can be suspended by the court, police, VicRoads or the sheriff.

If your licence was suspended by the police the details of your charge would have been referred to by the Magistrate, in which case they should have considered time served. Depending on what you had your licence suspended for, the Magistrate may have decided at their discretion to suspend your licence for a further 24 months after the initial 5 months.

Unfortunately you only had 28 days to appeal the Magistrates decision and that's obviously passed. If you have read the Court documents and it does clearly state 24 months from the Court date, then that's the standing suspension.
