Can some explain if the Suitors Fund Act applies to a litigant who first lost proceedings but the on appeal won? Due to the error of the first Tribunal member, the applicant was granted a dismissal of the first decision and granted another hearing upon which she chose not to proceed and dropped the claim at the first hearing . There were considerable legal costs in preparing for the initial hearing. She self represented at the appeal and won. Has she got any possibility of claiming costs of the first hearings dismissed decision?
