1) I need the National Measurement Act to prove that the radar devices do not comply, therefore, radar readings shall be null and void, which I assume would be under Aust Std listing. Anything to do with weights and measures must comply with the act, which would be defined as taking measurements for "any legal purpose".
I am trying to prove that they do not comply in respect to calibration and testing. As in RBT's and drug testing units, I do not believe that they are or can be certified to take these samples, so if they can't be certified, how can they legally be able to charge you on either count, when they are not legally able to take the sample? With this scenario, my breathaliser, which is calibrated, by the way, is just as accurate as theirs. I hope you can see what I am getting at.
2) I will assume it is the Transport Operations (Road Use Management) Act 1995 is to ensure that they have complied in every way, which should get back to who does their testing of radar devices, which should be accredited in accordance with a N.A.T.A testing authority.
3) Because the law of the commonwealth prevails over the law of a state. Refer back to weights and measures.
4) This says all(people) will comply to the Commonwealth Constitution.
5) 15KJ Government issuing agencies to comply with the request. The chief officer of a Commonwealth government issuing agency who receives a request under section 15KI must comply with the request within the reasonable period stated in the request.
I am requesting the information to see that they have the "lawful" right to make the claim, by producing the appropriate proof of claim by a sworn affidavit and supporting documentation. Is it not reasonable to ask this question as they are making demands of my son with unsubstantiated claims. So, therefore, out goes all fairness and principles of equality. Maybe I just see things from a different angle.
