My husband was instructed to stay back on a project at the end of his swing to carry out some re-work (yes, he made the mistake). The work would have been within the overtime bracket but they are re-fusing to pay him OT - offering a day in lieu instead.

Is this legal under employment law?

To add to Rod's comment, it was your husband's mistake, I think it is more than fair they gave him time in lieu, if seeking paid compensation, it may affect future relationship with his employer.

My personal point of view, if I make a mistake, then I will put the hours from my time to re-do the work. This is what I do.
