Firstly, is the change of name of trustee for a superannuation fund holding listed shares a "transfer" under the meaning of Reg 7.5.10? ie no change in beneficial ownership.
Secondly, the company (via its registry agent) is refusing to register the change of name unless I pay a fee of $62, despite the company's constitution strictly forbidding such a fee being charged. Weirdly enough, tThe ASX has deemed this to be "reasonable" in its application of LR 8.10.
Does this require a "Correction of Register" under s175 (the trustees ceased to be "owners" on adoption of the amending deed) or is this a "Refusal to register transfer" requiring action under s1071F?
