Hi,

My mother recently passed and she has a very simple will with us three siblings all executors of will. Mum's house is clear of debt and my brother might move in. I live interstate in QLD, the property which has two dwellings, one currently rented is in the NT.

How can we make it fair for all three of us?

Thank you

This is a question perhaps better asked of the Wills and Estate Planning forum, rather than Family Law.

Either sell the property and split the proceeds as per will or retain the property, split rent of rented property 3 ways, and have the brother who is moving in pay commercial rent with 1/3rd going to each brother (ie he pays himself 1/3rd).

If the brother living at the house is acting as manager, pay him 2/3rds of what a rental manager would get for managing the rental property (the other 1/3rd is what he pays to himself).
