VIC Someone sending public transport infringements to my address

    Hi Everyone,

    Quick question, someone I know has received public transport infringements.

    They have given a false name and my address.

    I know who the person is as they told me they were going to do it, and for me to send them the fine when it arrived.

    Is there any recourse here, or impossible to prove?

    What proof do you have other than the person's word? If you claim (stating this as no proof yet) the person did it in court, how can you prove it? the person will surely deny it! From your post it seems the person will take responsibility for those tickets.

    I think all you can do is reject them stating it is not you and you may need to go face to face with the inspector who issued the infringement to confirm that it was not you (actual sighting you). This is my opinion, I am not a lawyer but I'm sure someone will correct me if I'm wrong.

    Agreed just checking if there was any recourse :)

    Yes they verbally said it was them but nothing in text.

    I did chat with the transport police in person when I was on the train, and they said report it right away. There might be a trail with this person or write a stat dec?

    Do this, sooner rather than later. Also write down what was said, where, when, who with. Also write down your travel on the day on question while you have a chance of remembering things.

    Hopefully it turns out OK, but be prepared in case it doesn't.
