Hi there,

My neighbours have just replaced their retaining wall and on top of that retaining wall was a pool compliant timber fence. We have the pool they do not, however they own the retaining wall and requested that the timber fence be placed on top of of the wall so that it would look better from their side back in 2003.

Now they are refusing to replace the fence and forcing us to bear the cost and organisation of the fence replacement. They have also removed our landscaping that was on our side of the fence and claiming that is their land.

Surely they have the responsibility to return our property back to the condition that it was prior to their maintenance.

We have offered to go halves on the fence and pay extra for the upgrade to make it pool compliant like the original fence but they are going to remove the temporary fencing and put up some sort of netting.

Its getting all consuming and challenging, please advise<
