Greetings All

My Mother passed away 2 months ago. Dad was 15 mths ago.

Sadly her will was the one created back in late 1973.

We are having trouble locating the executor named in the will.

I can not track him down via any means. I have reason to believe he is dwelling in NSW.


He is not listed as practicing law in Victoria or NSW.

How exactly do I initiate proceedings in court to remove him and appoint myself (and/or my brother) to be the executor(s) of the will?

Any pro forma applications or is it via written submission etc

Any guidance would be appreciated

This is a rather simple matter which I believe I should be able to represent myself
