Hello,

I made a personal loan of over 100k AUD to an individual in Japan and had the contract drawn up by my lawyer. This person cannot pay back at the due date but is willing to pay monthly. However, I wish to make a default on the original contract and go to litigation.

What can be done to ensure this person, not in AUS, will pay?

Speak to your lawyer who drafted the contract - only they know the full details and your rights and remedies under the contract, including things like the dispute resolution clause and governing law clause (if any in the event of a default).
