QLD Partnership | Legal action and termination

    Hi there,

    Im currently doing a case study ILAC.
    Can you take legal action against someone in a partnership who is in the partnership?
    And how can you terminate the partnership due to wrongful acts?

    Background:
    3 brothers were in a partnership in a restaurant and agreed any expense over $5k was to be joint approved
    1 brother opened a pop up restaurant in the same restaurant owned by the brothers
    The brother worked up a bill of $40k with out any of the other brothers consent
    The other 2 brothers want to take legal action as the other brother left the country but intends to return

    This is what we call a "homework question".

    We won't write your essay for you, but...

    (i) Sure, partners can sue (and cross claim, and do other things to) each other
    (ii) Have a read of this for starters. Note that it contains a link to useful Queensland legislation.

    Be sure to cite it properly. Most Law Faculties prefer AGLC. Check the instructions.
