QLD Parent Took Child from School - Is This Abduction?

    If a non-custodial parent took a child from school, refusing to return the child to the custodial parent, where there is no court order involved, what can the first custodial parent do? Would this constitute a case of abduction?

    No court order, no rules for parenting, so who collects the child from school is quite literally free game. It's not abduction, even if there is a Court order in place. Such a word is reserved for cases of international relocation without consent.

    What can you do?

    You can apply for a recovery order, but you'll likely need to apply for parenting orders concurrently. I'd seek legal advice from Legal Aid before acting.
