My brother is executor of my recently deceased sister's will and he refuses to authorise my access to her medical records in order for me to progress some complaints I have about her treatment. The reason he gave is that he does not want to involve the estate, which he says could be implied if he gives the necessary authorisation.
I want to approach him again but would like to first know if there are any circumstances where an estate that has been properly distributed to the beneficiaries can still incur costs eg be sued and if so, who would pay those costs eg the executor? I think he is worried about the estate being somehow sued although I have no intention of sueing anyone.
