If someone owned a house that is not the family home for 12 years before a marriage, is that property counted as part of the couple's assets in property settlement? The marriage has been 6 years in length and there is also a family home.

Was it disposed of prior to marriage? Or did they still own it for the duration of the marriage?

Yes, it has been owned for the entirety of the marriage and is still owned. There is no prenup.

Then yes, it will be considered as part of the shared asset pool, but obviously, the party who owned the house prior to marriage will be considered to have made greater contributions to it.
