How will the
family court determine what's best for a baby (Residence, etc)?
The Court refers primarily to section 60CC of the Family Law Act for considerations when determining what's best for a child: FAMILY LAW ACT 1975 - SECT 60CCHow a court determines what is in a child's best interests
There are various other factors which guide the court's decision, including the child's legal rights (s60B) and parental responsibility, but the child's best interests are always paramount.
