Hi

Is there any further information you can provide on your query? There are a few different things to consider here, but it would be difficult to point you in the right direction without some further details, such as:

  • What are the items?
  • Do you know who the owner is?
  • Has the owner in any way attempted to recover the items or to assert their ownership over them in any way?
  • Are you the legal owner or tenant in possession (ie you have a lease) for the property the items are currently on?

the items are
  • a motor vehicle
  • a prime mover
  • several heavy motors
We know who the owner is and we have made regular attempts over the last 11 months to recover the costs from him for the transport. he always has excuses for not being able to pay his invoice.
The property the items are currently on is that of the owner of the transport company.

Just so I understand, you are asking this question on behalf of your employer who is a transport company and who also owns the land?

Does your company happen to have standard trading terms, terms of service or terms and conditions it gets customers to agree to when booking in transport?
