Hi , can anyone help with this issue please ?
What happens if you don't do property settlement within 12 months of divorce?
We have a house that is worth less than the mortgage and each others super.

Can I have orders made stating that it’s held until such a time that the market improves ?

If you and the ex can agree, then no orders required. This is always the best option especially given it looks like you're gonna lose $$ on the house so do you really want legal fees on top of that?

If you guys agree, then you can have something in the orders about one person staying in the house and that it goes on the market in 2yrs for example and then have orders explaining who is paying the mortgage / rates etc etc.
How amicable are you and the ex?
