My daughter has been separated now for 2 months and has applied for child support of a 5 month old. The father is not on the birth certificate and he refuses to sign Stat Dec to say he is resulting in no child support payments from him. He has applied for mediation to have custody of the child and was wondering what his entitlements are if he doesn't wish to sign off on being the father.

Interesting that he's seeking custody of a child that he won't acknowledge as his. Has she contacted Child Support yet? She needs to file a claim whether he is on the birth certificate or not, so they can seek back payment when the paternity issue is settled. Were they married?

Child support were the ones that sent him the stat dec to sign for verification of being the father but he refused, they were not married. The mediation is for shared custody.

child support is payable from the time of applicaiton... So even though he is denying parentage, he will need to deal with that issue before reasonably expecting to spend time with the child... That should mean child support will need to be back paid from the time of applicaiton.

Look if dad thinks he's gonna automatically get 50/50 of a 5 month old, he is kidding himself and he is not helping his case IF it goes to court by not paying chid support...

Your daughter should contact lefal aid - it is likely that she will be entitiled to some assistance from them...

Im no expert but I would have thought if he takes it to court the judge will want to know why he wants to see/have custody of a child he refuses to sign to say is his, or help support financially.
I would tell the mother to keep open lines of communication with child support and stay focused on the best interests of the child during the mediation sessions.

it looks like he may just resolve your problem for you. As long as the child support claim stays open he will be liable for back payment. Your daughter should inform the child support agency about the mediation.
