Just wondering how to write a relocation order under Family Law? How should I format it and what to write in it? Do I include suggestions about how the other parent will see our child?

Hi,

Is this an agreed relocation or is it in dispute? If its agreed then you wouldn't include suggestions it what ever the other parent as agreed to.

If it's in dispute are you writing your application for relocation to the court? The best way is of course to agree and apply to the court for consent orders. If its in dispute the court will need to determine in the move is in the best interests of the child.

Maybe a better question is to ask whether or not it is worth it...

So how much time does the other parent spend with the child? What are the circumstances around that...? So if the other parent only sees the child every 3-4 weeks by their own choice, then you have a better chance. If, however, the other parent only sees the child every few weeks because you won't let them have more, well that ain't a good look.

If the other parent sees the kid for 4-5 nights a fortnight then you might want to ask yourself whether or not it is worth the effort... No one here can tell you whether or not you're gonna be successful. But the circumstances around the child's relationship with the other parent is going to be a significant factor in your chance of succeeding.

Example:

1. That the child live with the mother.

2. That the mother be permitted to relocate with the child from (Town A) to (Town B) within three months of these orders being made.

3. That from when the child relocates with the mother, the child spend time and communicate with the father as follows:

a) Every third weekend from after school Friday until 5:00pm Sunday;
b) The first half of all gazetted school holidays.

4. Until the mother relocates with the child, and in the event the mother does not relocate, that the child spends time and communicate with the father as follows:

a) Every second weekend from after school Friday until before school the following Monday;
b) From after school each Wednesday until before school the following Thursday;
c) The first half of all gazetted school holidays.
