Hi all.

I am in the depths of responding to an initiating application in family court where the father has filed a notice of risk and is seeking residency and parental rights. All of his claims are either extremely false or inflated and I can prove this. I currently have the kids 9 days/fn except for bub who goes there in the days and sleeps 2nights/fn.

My question is: what is the best approach, (a) ask for orders to go back to mediation and sort out a flexible schedule of increasing time till bub is older and all kids are adjusting well or (b) ask for orders of a specific time with a review in 6-12m?

(b) first, but along the way you can ask for mediation. Note the other side doesn't have to agree as I assume there is already a valid 60I certificate.
