My partner's brother claimed in a sworn affidavit in the supreme court that he gave her nearly one million dollars because she kept asking him for money and to stop using his private documents - actually their family businesses records. The money was paid from a solicitor's trust fund to her but was actually for settlement for a house they jointly owned.

He also submitted a statement of claim for damages. My partner had hired a QC to defend the statement of claim and eventually settled out of court through mediation saying that the said docs could only be used if required by law. They both paid their own costs.

Can she take action against him filing a false affidavit? She has all the settlement records of the money transfer from the solicitors trust fund to her account.
