I separated from my ex a year ago after a 6 year defacto relationship. He moved out and I stayed in the family home with my kids, which my ex and I own as joint tenants. I pay the mortgage, rates, and utilities (always have).

I want to buy him out if possible (or sell and split proceeds if not) but he won't participate in my attempts at settlement negotiations, and I can't afford to take him to court. He wasted most of my very limited funds for legal fees on pointless correspondence that didn't progress the matter whatsoever.

Meanwhile he benefits from improved equity in the property at my expense and insists on using "his" garage for free storage.

Are court proceedings my only option to get settlement happening and get my life back?

What happens if we don't settle before the 2 year post-separation period is up?
