QLD Ex Sent Son Overseas - What to Do Under Family Law?

Hi guys,

Long story short, we've been separated since March this year. Since, then I was barely allowed to see both of my sons because she's a dead beat, and when I get to see them, it's only a short 20-30 minutes at the park opposite her house.

So yesterday when I requested to see them again. She told me she has sent the older one back to China because he's getting to the age when he's very naughty and she can't handle taking care of two children at the same time, and without me agreeing and knowing, she sent him back, I was pissed off.

What can I do here under family law? If anyone can answer my question, it would be really great of you.

If your child was taken out of Australia without your consent, you should contact the Commonwealth Attorney-General’s Department for assistance.

Australia has an agreement with some countries to return abducted children to Australia, however I don't believe mainland China is one of those countries - although Macau and Hong Kong are.
