Hello,
I have a question regarding a housemate, who refuses to vacate. I rent the house and am the only tenant on the lease. I gave him verbal notice of three weeks today, but he told me that he refuses to leave and its not my house and called the police on me. Who were more annoyed for wasting their time. My understanding is he is not a tenant but rather a lodger, as he is here on a verbal agreement, and I can have him removed by force after days? The police didn't understand this and told me to contact the tenancy board and local courthouse. Which piece of legislation can I produce to the police to have him removed asap?

He has no written agreement, so I understand is not covered in the NSW Residential Tenancies Act, he also has no exclusive use of the residential premises. So I would assume that makes him a lodger.
