Hi all,

My little brother had a double lung transplant 6 years ago. All the medicine has put strain on his body. The last 2 months he was made manager at the restaurant / bar he works. He was hospitalised for 4 days recently due to failing kidney function.

Whilst in hospital his boss texted him and said he won't be manager anymore as he took time off. They knew about his condition when he started employment. Does this come under discrimination?

Please help

Can potentially be discrimination under both the Fair Work Act and WA's Equal Opportunity Act.
