Hi Folks,

I have had two local Queensland Councillors claim that to publicly discuss a development application before Council would be an "offence under the act". I have looked through LGA 2009 but can find nothing. Know I could be missing it in 329 pages.

Does anybody know which section of which act they may be referring to?

Seriously though, they are probably just parroting
something they heard at a Local Government Ethics Seminar or somesuch.

In legal terms, subject to an unspecified number of ifs, buts, and variables,
they might, even if they properly don't know it, be referring to public discussion of an as yet unmade decision as being inconsistent with section 4 (2)(d).

I am not however sure how it could be an offence.

Thanks, I saw that section and mentioning transparent / social inclusion / meaningful community engagement seemed to be swaying the other way from silence as the DA's are posted publicly on the Council website

But the deliberative processes are not public.
