NSW Commercial Law - Difference Between Home Business and Small Business?

    Hey guys,

    I currently run a business and I am being forced out of my current home on the basis that I do not classify as a home business due to the size of my operation. Previously I ran my tutoring business from home and only had a few customers so it was not a problem but now that I have grown and have more customers and a couple of employees, which means apparently I no longer classify as a home business.

    Could someone please tell me where the line is drawn under the commercial law between home businesses and small businesses and provide some links to websites where I can read up on this.

    P.S. I live in the Hills Shire Council

    It is up to each council. Look for their zoning rules.

    You are not being forced out of your home. You are electing to grow and expand and it is only appropriate that the council looks after and maintains the residential character around people's homes. Increased traffic and noise is not appropriate in residential areas and the council has properly and appropriately developed rules so that people can have the quiet enjoyment of their homes.

    See the increased growth as a good thing, you just need to cope with expanded overheads, same as other business manage.

    Council will have given you the basis for their action in whatever the latter is they have written to you.

    One question - How many employees, who are not residents of the house where the business is?
