Hi there.

First time posting. I wish to take legal proceedings against my workplace after a series of events which escalated severely after I reported a lower management level supervisor (aged in his fifties) for showing me child pornography and clearly detailing his sexual dealings with dozens of middle aged teenagers overseas.

I'm hoping I have a case for negligence or anything else that would fit in this case.

A huge road block for me will be that this company is a very large Melbourne based company which works closely with government entities and has a workforce of 3,500+ employees. I feel that the only way for me to successfully tackle this case financially would be on a 'No Win No Fee' basis with a settlement agreement in place or pro bono legal assistance. Please if you have any suggestions feel free to comment.

I will attempt to summarise the events as best as I can as there's over 4 years of bullying, harassment, vilification and discrimination which severely escalated about 2 years ago when the reporting of the above occurred. Apologies in advance for the essay, and I do have evidence and documentation of quite a lot of the below with dates and times.

I'll start from where everything ramped up.

Things escalated when a supervisor showed me child pornography at my workplace and stated that he had engaged in sexual intercourse with 40 to 50 middle aged teenagers overseas. Human Resources Dept. effectively disclosed to the supervisor that I was the whistle-blower and in turn has blocked me from ever getting promoted due to his relationship with existing managers and has sparked intense backlash against me in the workplace not limited to verbal abuse, harassment, bullying and defamation.

The supervisor was allowed to retire with all his entitlements and continues to work now as a contractor conducting works for my employer but holding a different title now. I still have to deal with him in my duties, despite the fact he holds a criminal index number and there is clear evidence if police are duly advised of the information regarding the matter.

My employer has mishandled several investigations, covered for staffs wrongdoings against me even in cases when there was witnesses and CCTV evidence, replying to me saying my claims have to warrant or simply not following through with an investigation.

I've had wrongly placed errors on my file including falsifying the allocation of government issued monetary penalties and statistics onto my error, in some cases the error itself was discrimination as other staff committed the exact same error, in one case two times consecutively and were completely overlooked.

My employer has discriminated against me with select people receiving rewards when staff have called out good behavior or good work practice, but in several cases when I received a commendation and in one case from an external party nothing ever eventuated out of it.

Middle management held the illusion that I was going to be relocated to another position with a similar or higher salary after I attempted to put a work cover claim in. I was instructed to withdraw the claim and would be paid as per roster for a small period of time instead if I agreed to withdraw the claim. For the purpose of not recording a work place injury.

All that happened in regards to a new role was that I went for several false job interviews, one where I was promised a job. Some of these positions had already been allocated and in one interview I was notified that I was successful to the role and I was later on notified by email I was now unsuccessful to that position.

I now suffer from headaches, stress, anxiety, anger management issues, when under stress a severe deterioration of mental capacity, sleep problems, I wake up grinding my teeth in my sleep and they seem to have worn down, I’ve been advised to get a mouth guard to sleep with, small disagreement or arguments now rattle me greatly. I've taken up smoking full time which used to be a social habit for me and have started drinking more often as well. I've had several psychologist appointments and may be suffering from PTSD, chronic depression and anxiety as a result of these events and I also struggle to unwind after work for several hours and it's all taken a toll on my current personal relationship.

I'm unsure of what action to take at this point in time or what avenue to go down. I have limited funds due to my financial situation but would really like to aim towards claiming for punitive damages, retirement & pension losses and compensation for emotional and mental distress.
